29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access: (a) Luis Ortiz Roofing, at 425 Wood Road, Snowmass Village, CO: On and preceding 8/28/18, the employer did not ensure that portable ladders used for access to an upper landing surface had the ladder side rails extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access. Employees were re-roofing a four story condominium complex. Two job built ladders, constructed of wood 2 x 4 pieces, were used to access the fourth story roof from the third story. Each ladder's side rails extended approximately one foot above the upper landing surfaces. These conditions exposed employees to approximate ten foot fall hazards.
