29 CFR 1910.23(b)(10): The employer did not ensure that any ladder with structural or other defects was immediately tagged "Dangerous: Do Not Use" or with similar language in accordance with paragraph 1910.145 and removed from service until repaired in accordance with paragraph 1910.22(d), or replaced: On or about February 22, 2018, employees were exposed to fall hazards up to 10 feet to a concrete floor when the mobile ladder in D section had not been taken out of service and had been used for at least two months while rocking. The ladder had the following defects: a. bent brace b. missing rubber foot cap c. dented step d. rocked when locked in position No abatement certification or documentation is required for this item.
