29 CFR 1910.95(k)(1): The employer shall train each employee who is exposed to noise at or above an 8-hour time weighted average of 85 decibels in accordance with the requirements of this section. The employer shall institute a training program and ensure employee participation in the program. a. On or about May 25, 2017, An employee working on the accessories pouring line was exposed to noise at 128.6% which exceeded the PEL (Permissible Exposure Limit) of 100%, an 8-hour time-weighted average sound level of 90 dBA. The employee's 8-hour TWA sound level was approximately 91.8 dBA during the 480 minute sampling period on May 25, 2017. The employer had not ensured that employees with noise exposures equal to or exceeding an 8-hour time-weighted sound level (TWA) of 90 decibels measured on the A scale (slow response) or, equivalently, a dose of 50 per cent, had been adequately trained on the proper way to wear hearing protection..
