29 CFR 1910.146(d)(3): Under the permit-required confined space program required by 29 CFR 1910.146(c)(4), the employer did not develop and implement the means, procedures, and practices necessary for safe permit space entry operations, including but not the items outlined in subparagraphs (i) to (vi): a) Electro Chemical Manufacturing - An employee, a Spray Liner, enters a stationary mild steel tank, a permit required confined space, to apply EL-CHEM 202 Kynar White paint by spray applications. This paint contains Diisobutyl Ketone a flammable liquid and Dimethylphthalate. The employer did not implement procedures to test the atmosphere before and during entry as required by this section on or about January 19, 2017. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states that employees and their representatives were informed of this abatement.
