29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was required to use the respirator in the workplace: (Construction Reference 1926.103): a) On or about 7/19/2016, throughout 960 Broadway building, for the laborers performing demolition and clean up activities, who were required to work in and walk through these areas, and who were otherwise exposed to particulates not otherwise regulated (PNOR), asbestos, and lead. No medical evaluation was provided to the employees when they were required to wear a respirator to continue working.
