29 CFR 1910.95(d)(1): When information indicated that any employee's exposure equaled or exceeded the 8-hour time-weighted average of 85 decibels, the employer did not develop and implement a monitoring program: At the inspection site, where noise screening measurements on or about March 6, 2013 showed employees were exposed to intermittent noise levels as high as 99 decibels from powered wood cutting equipment, 93 decibels from pneumatic nail guns, and 102 decibels from hammers while manufacturing wood trusses, the employer did not monitor employee exposures to noise. Sawyers were exposed to noise levels in excess of the allowable 8-hour Time Weighted Average (TWA) sound level of 85 dBA. This violation was observed on or about July 26, 2013 for 2 Sawyers, where noise sampling performed for 480 minutes indicated that the operator of the Monet De Sauw and Cyber A/T saws was exposed to an 88.8% noise dose which is equivalent to approximately 89.1 dBA, and where noise sampling performed for 479 minutes indicated that the operator of the Smart Set Pro and Cyber saws was exposed to a 68.6% noise dose which is equivalent to approximately 87.3 dBA. Noise sampling performed for 477 minutes for a Catcher on the Monet De Sauw and Cyber A/T saws indicated that the employee was exposed to a 61.9% noise dose which is equivalent to approximately 86.5 dBA. Zero exposure was assumed for the minutes not sampled.
