Text For Citation: 01 Item/Group: 002A Hazard:
29 CFR 1910.95(d)(1): When information indicated that any employee's exposure equaled or exceed the 8-hour time-weighted average of 85 decibels, the employer did not develop and implement a monitoring program: a. Hearing protection was not worn or not worn consistently during operation of saws and pneumatic nail guns; there was no monitoring conducted to determine 8 hour time weighted noise measurements, the need for implementing a hearing conservation program (providing hearing protection at no cost to employees, annual hearing tests and training), and hearing protection required areas. Sound level meter measurements at the time of the inspection were up to 105 dBA. (Note: if a hearing conservation program is established, including annual hearing tests and training, and heraing protection required for saw line employees and nail gun users, noise monitoring would not be required.) Abatement certification and abatement documentation is required for this violation. The documentation should include written verification of abatement, applicable measurements or monitoring results, and photographs or videos which you believe will be helpful. The abatement certification sheet is enclosed with the citation(s).
