29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative: a) Yard, dry stack area - On or about 01/23/13 employees were reinstalling the main hydraulic cylinder in the Wiggins four-stage boat forklift Model No WG186YM, S.N. WLC771114, which required work under an elevated and suspended load composed by the three moving stages, the carriage, and the fork. The employer did not develop and implement a program for the control of hazardous energy to protect workers from crush hazards due to potential (gravitational) energy, and hydraulic energy. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
