OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing for likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards due to the absence of marking on the "Below-the-Hook Lifting device": a) In the contract manufacturing area, the 2 ton Harrington crane - On or about July 25, 2012, the Below-the-Hook lifting device did not have any markings or inspection plate. All structural and mechanical lifting devices shall be marked with, but not limited to, the following; - Manufacturer's name and address - Serial number of the device - Lifter weight if over 100 lbs (45 kg) - Rated load [as described in para. 20-12.2.1(a)] - ASME BTH-1 Design Category and Service Class (if applicable) Reference ASME B30.20-2006, Chapter 20-1 Structure and Mechanical Lifting Devices in Section 20-1.2.1 Marking Identification.
