Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to dust explosion, deflagration, and other fire hazards: (a) For the employees working in the packaging warehouse where a dust deflagration hazard existed in the packaging mezzanine from paper dust accumulations covering the entire surface of the floor and other surfaces over 1/32 inch without having the room protected from the effects of dust deflagrations by separation, building construction, or deflagration venting, at American Crystal Sugar Company, located at Rural Route 2, Hillsboro, North Dakota. Abatement Note: Among other methods, one feasible and acceptable method to correct this hazard is to follow the NFPA 654, National Fire Protection Association - Standard for the Prevention of Fire and Dust Explosions from the Manufacturing, Processing, and Handling of Combustible Particulate Solids, Section 6.4.1, including, but not limited to, installing deflagration venting in the outside walls or control dust emission sources and improve housekeeping.
