Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposed to struck by hazards, and/or, fall hazards: a) Empire Wrecking at St. George's Lithuanian Church, Shenandoah, PA. On February 01 2010, employees were working from the basket of a JLG 1250AJP aerial lift, that was positioned within 6 to 12 inches underneath the boom and arm, of a Hitachi EX 450LC excavator that was extended over the basket. Among other methods, feasible and acceptable means to correct this hazard is to ensure the excavator operators follow the manufacturers warnings stating that personnel are to be kept out of work areas and never position a bucket over anyone.
