Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing or struck-by hazards when operating a forklift without using the seatbelt: In the shop: On our about June 18, 2009, and at times prior thereto, the employee operating the Yale forklift did not use the seatbelt nor was he required to do so. Note: Among other methods, one feasible and acceptable means of abatement to correct this hazard would be to establish a work rule that seatbelts be worn when operating the powered industrial truck and ensure the work rule is enforced by conducting periodic inspections of the operator(s). Note: Abatement certification required for this item.
