North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to falls in excess of 10 feet from a platform on the forks of the lift truck: a)jobsite- the employee was laying brick over a window of the house from a wooden pallet on the GEHL, BMI-2, RS5 industrial truck designed to lift material on the extendable fork lift truck without the protection of guardrails at 16 feet and 8 inches above the compacted ground below. [Reference ANSI/SIA A92.2-1990, Section 10.2] One reasonable and acceptable method of abatement would be to provide scaffolds for employees to protect them from falling to the ground.
