Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed hazard of potential fire and explosion because fixed bulk storage units and air-material separators (dust collectors) were not designed to minimize damage that would occur in the event of a dust explosion inside the machines: a) Stearate Area, L2 Room - On or about January 13, 2006 bagger room product hopper was located inside the building and did not meet the protection, venting or size requirements for inside bulk storage. b) Stearate Area, L3 Room - On or about January 13, 2006 room product hopper on the bagger system was located inside the building and did not meet the protection, venting or size requirements for inside bulk storage. c) Flaker Area - On or about March 21, 2006 air-material separator was not located outside of the building or provided with explosion venting to the outside or equipped with an explosion suppression system. d) Slab-Dip Area - On or about March 21, 2006 air-material separators were not located outside of the building or provided with explosion venting to the outside or explosion suppression systems. Among other feasible methods on method to abate these hazards would be to ensure that organic powder processing areas comply with all the requirement of NFPA 654. Bulk storage and air material separators should be located outside or provided with systems or devices to protect employees from any explosions which may occur in this equipment. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
