29 CFR 1910.23(c)(1): Open-sided floor(s) or platform(s) 4 feet or more above the adjacent floor or ground level were not guarded by standard railings (or the equivalent as specified in 29 CFR 1910.23(e)(3)(i) through (v)), on all open sides: a) Ammonia Room/Platform by Condensers - The guardrail at the platform edge did not have a midrail. Employees were exposed to a fall of approximately 8 feet. On or about 2/21/12. b) Peg Line/Truck Dumping Area - The edge of the hopper where vegetables are dumped from trucks was not protected by guardrails. Employees were exposed to a fall of approximately 13 feet. On or about 2/21/12. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
