29 CFR 1910.134(e)(1):The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:(a) a. On or about July 28, 2025, Torch area: employees were exposed to respiratory hazards, in that, an employees performing torch application on steel and aluminum parts using a Gerson 9350 Silicone Half Mask Face respirator was not fit tested prior to initial use of the respirator and at least annually thereafter.
