29 CFR 1910.178(p)(1): Powered industrial truck(s) found to require repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition. On or about 5/21/2024, in the facility located at 1743 Scherer Pkwy in St. Charles, MO, the employer did not ensure a defective forklift was removed from service when the breaks broke. Employees using the forklift to move material and employees in the area while the forklift was operational were exposed to struck-by hazards.
