29 CFR 1910.120(q)(1): The employer did not develop and implement an emergency response plan to handle anticipated emergencies prior to commencement of emergency response operations: a) 156 West Harrisburg Avenue, Elizabethtown, PA 17022: On or about February 28, 2024, an employee responded to the ammonia leak and conducted maintenance activities on the ammonia refrigeration system to contain the leak. The employer did not develop and implement a written emergency response plan that outlined procedures involving emergency response for employees responding to ammonia release incidents. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
