29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary: On or about October 27, 2023, and at times prior to, employees were engaged in work activities related to installation of pipe in a trench, where the following: a) At the western side of the trench spoil pile was not at least 2-feet from the edge of the excavation. b) At the air condition unit, the spoil pile was not at least 2-feet from the edge of the excavation. c) At the eastern side, the spoil pile was not at least 2-feet from the edge of the excavation. d) At the western side by the manhole vault, the spoil pile was not at least 2-feet from the edge of the excavation.
