29 CFR 1910.134(c)(2)(i):The employer did not determine if the voluntary use of a respirator did not in itself create a hazard. At the bagging, crushing and mixing areas, employees engaged in fertilizer manufacturing activities while voluntarily using respirators were exposed to health hazards in that the employer had not determined that the respirator itself will not create a hazard. Employees voluntarily wore 3M half mask respirators and N95 respirators.
