29 CFR 1926.1203(a): Before it begins work at a worksite, each employer must ensure that a competent person identifies all confined spaces in which one or more of the employees it directs may work, and identifies each space that is a permit space, through consideration and evaluation of the elements of that space, including testing as necessary: At a worksite located at 1251 Mill Road, Green Leaf, WI 54126; the employer did not ensure that a competent person identified all confined spaces and permit spaces. The employer directed Plumber employees to work in the Pump Pit and the competent person did not identify it as a confined space or permit space through consideration and evaluation of the elements of the Pump Pit. Employees entered the confined space of the Pump Pit via extension ladder and worked in the pit which had the potential for a hazardous atmosphere caused by combustion-engine byproducts and/or hydrogen sulfide from near-by manure processes.
