29 CFR 1910.95(c)(1):The employer did not administer a continuing and effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a) Imperial Marble & Granite, Inc. located at 10 Industrial Hwy Building H Lester, PA: On or about April 22, 2022, the employer did not administer a continuing, effective hearing conservation program for employees performing polishing activities and exposed to continuous noise levels equivalent to 99.7% and 109.5% of the allowable 50% dose for an 8 hour time-weighted average (TWA). These exposures are equivalent to an 8 hour TWA of 89.9dBA and 90.6 dBA respectively, exceeding the OSHA Action Level of 85.0 dBA for an 8 hour TWA. Sampling times were 322 and 317 minutes respectively. Zero exposures were assumed for all unsampled time periods.
