29 CFR 1910.1053(d)(1):The employer did not assess the exposure of each employee who was or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2) or the scheduled monitoring option in paragraph (d)(3) of this section. a) On or about December 02, 2020, throughout the facility, employees (Forklift Operator/Laborer) were exposed to silica above the PEL in concentration of 149mcg/m3 filling bags of gravel/sand/pebbles aggregate and stacking bags on a pallet without an assessment of their personal exposure. b) On or about December 02, 2020, at the Aggregate Filler machine, employees (Laborer) were exposed to airborne Crystalline Silica in concentrations of 176.3mcg/m3 while filling bags of gravel/sand/pebbles and stacking bags on a pallet. c) On or about December 02, 2020, at the Aggregate Filler machine, employees (QC/Laborer) were exposed to airborne Crystalline Silica in concentrations of 75.2mcg/m3 while filling bags of gravel/sand/pebbles and stacking bags on a pallet.
