29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: a) 1515 Lamberts Mill Road Operations, LLC dba Westfield Center/Westfield, NJ - Throughout the nursing home: On or about 4/2/2020 and continuing thereafter, employees including, but not limited to nurses, nurse supervisors, and certified nursing assistants were required to wear N95 respirators when providing direct nursing and personal care to patients suspected or confirmed as having COVID-19. Employees required to wear N95 respirators were not provided medical evaluation and clearance.
