29 CFR 1926.200(g)(2): The design and use of all traffic control devices, including signs, signals, markings, barricades, and other devices, for protection of construction workers shall conform to Part 6 of the MUTCD (incorporated by reference, see �1926.6). On or about March 12, 2020 and prior to that time located on OH-28 between 15751 OH-28 and US-50 Chillicothe OH 45601 for a short duration or mobile utility construction work crew in which the employer opted to utilize temporary traffic control work zone flagger stations and flaggers on a two lane rural 45 mph roadway the employer did not conform to 2009 MUTCD Standard Part 6E.08.04, in that, the employers use of a traffic control device Advanced Warning Signs in a three-sign series closest to the temporary traffic control zone point of restriction was in excess of one mile from the zone while the 2009 MUTCD Table 6C.1 Recommended Advance Warning Sign Minimum Spacing for Rural (A) is 500 feet. There were also various areas where there were no flagger or flagger station Advanced Warning Signs placed by the employer immediately downstream of intersection or major driveway so that that traffic turning onto the OH-28 roadway in the direction of the Temporary Traffic Control zone would be warned of the upcoming work zone. 2009 MUTCD Standard Part 6E.08.04: Except in in emergency situations, flaggers stations shall be preceded by an advanced warning sign or signs. Except in emergency situations, flagger stations shall be illuminated at night.
