29 CFR 1910.29(b)(1): The top edge height of top rails, or equivalent guardrail system members, were not 42 inches, plus or minus 3 inches, above the walking-working surface: (a) Packing Robot 10/11 - On November 19, 2019, the employer did not ensure that the height of top rail, on the entire guard rail system of the racetrack platform, was 42 inches, plus or minus three inches.The top rail for a portion of the guard rail system located at the end of the platform next to the south vibrato was lower and measured at approximately 36 inches above the walking working surface. In accordance with the requirements of 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete and must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase, or repair of the equipment, photographic or video evidence of abatement, or other written records.
