29 CFR 1910.178(p)(1): If at any time a powered industrial truck is found to be in need of repair, defective, or in any way unsafe, the truck shall be taken out of service until it has been restored to safe operating condition. a) On or about 9/12/19 the employer allowed employees to operate a Toyota Forklift (model # 42-5FG25) on a 10 degree incline driveway that had braking issues. The forklift was not removed from service until the brakes were repaired.
