Text For Citation: 01 Item/Group: 002A Hazard:
29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval: River Driver Service Center, Inc: On or about July 13, 2019 the employer utilized "free rigging" with alloy chains off the tines of the Windham W-15 STD forklift for a below-the-tine lift to support the tailgate section of Heil trash truck body during removal. The forklift manufacturer's or a professional registered engineer's written approval was not sought for this modification prior to this lift activity. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
