29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: On or about October 29, 2018, the employer did not instruct each employee in the recognition and avoidance of unsafe conditions in the workplace. Employees were exposed to struck-by hazards and caught-in hazards from collapsing soil in a 7.5 feet deep excavation. Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).
