29 CFR 1910.95(d)(1): When information indicated that any employee's exposure equaled or exceed the 8-hour time-weighted average of 85 decibels, the employer did not develop and implement a monitoring program: The employer did not develop and implement a monitoring program for employees, who worked in the sandblasting area, and were exposed to noise that had exceeded an 8-hour TWA of 85 dBA, based on an 80 dB threshold: (a) A sandblaster employee was exposed to continuous noise levels at 351.4% of the permissible 8-hour time weighted average (TWA) . The equivalent level of 351.4% is approximately 99.0 dBA. Sampling was performed for 226 minutes during one shift. Zero exposure was assumed for the 254 minutes not sampled; (b) A sandblaster employee was exposed to continuous noise levels at 365.8% of the permissible 8-hour time weighted average (TWA) . The equivalent level of 365.8% is approximately 99.3 dBA. Sampling was performed for 201 minutes during one shift. Zero exposure was assumed for the 279 minutes not sampled.
