29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that was 4 feet (1.2 m) or more above a lower level was protected from falling by one or more of the following: Guardrail systems, safety net systems, or personal fall arrest systems: (a) Options Medical Center dba Options, 1700 S. 120th St., Lafayette, CO 80026: On or before January 25, 2018, the employer did not ensure that employees were protected from injury, in that employees spraying plants on the top level of the racking system walked on two unsecured wooden boards that had been placed on top of the horizontal supports of the racking system. The wooden boards were side-by-side and measured approximately 1.5 feet in total width by 6 feet in length. On January 22, 2018 an employee who was spraying plants while walking on the boards fell approximately 9 feet to the concrete floor. This condition resulted in a fatality. (b) Options Medical Center dba Options, 1700 S. 120th St., Lafayette, CO 80026: On or before January 25, 2018, the employer did not ensure that employees were protected from injury, in that employees spraying plants on the top level of the racking system walked on two unsecured wooden boards that had been placed on top of the horizontal supports of the racking system. The wooden boards were side-by-side and measured approximately 1.5 feet in total width by 6 feet in length. This condition exposed employees to a fall hazard of approximately 9 feet to concrete. (c) Options Medical Center dba Options, 1700 S. 120th St., Lafayette, CO 80026: On or before January 25, 2018, the employer did not ensure that employees were protected from injury, in that the back wall of the upper floor in Veg 1 was not adequately guarded. This condition exposed employees to a fall hazard of approximately 6 feet.
