Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of being struck by falling portions of the hoisted load and/or crane structure of the Koehring (Bantam) hydraulic crane, located in the main yard area by the shipping office. Among other methods, one feasible and acceptable method for abatement is to provide a boom angle indicator and load rating chart for all mobile hydraulic cranes, as specified in Paragraph 15-1.1.3 and Paragraph 15-1.9.1 of the American National Standards Institute B30.15-1973, Mobile Hydraulic Cranes.
