29 CFR 1910.134(c)(1): In the workplace where respirators were necessary to protect the health of the employee or where respirators were required by the employer, the employer did not establish and implement a written respiratory protection program with worksite-specific procedures including the provisions (i)-(ix) of this section, as applicable: a) On or about 7/19/2016, throughout 960 Broadway building, for the laborers performing demolition and clean up activities, who were required to work in and walk through these areas, and who were otherwise exposed to particulates not otherwise regulated (PNOR), asbestos, and lead. The employer did not develop a respiratory protection program when employees were provided with respirators to continue working.
