29 CFR 1926.1417(u)(2)(i): A competent person supervises the operation, determines if it is necessary to reduce rated capacity, and makes determinations regarding load position, boom location, ground support, travel route, overhead obstructions, and speed of movement necessary to ensure safety. On or about June 12th, 2014, at the above address jobsite, the Bucyrus-Erie (SN:123333) was moved with the load without determining if the ground support and speed of movement was safe.
