OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish the employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees who were exposed to struck-by hazards: a) Yard / Class B Recycled Material Processing Area: On or about 06/10/2014 employees were exposed to potential struck-by hazards due to a CAT 938 front loader / wheel tractor being used to load recycled materials into truck without a functioning back-up alarm. b) Municipal Recycling facility: On or about 06/10/2014 employees were exposed to potential struck-by hazards due to a CAT 906 front loader / compact wheel tractor being used to load recycled materials into truck without a functioning back-up alarm.
