29 CFR 1910.178(m)(5)(iii): Powered industrial truck(s) with the operator dismounted and within 25 feet of the truck still in his view, did not have the load engaging means fully lowered, controls neutralized, and the brakes set to prevent movement: a) Facility Wide - On or about December 11, 2013, the employer failed to ensure that when an operator dismounted and was within 25 feet of Toyota fork lift truck (s/n 62136) still in the operator's view, the load engaging means of the vehicle were fully lowered, controls neutralized, and the brakes set to prevent movement while working on a paper roll. In accordance with 29CFR 1903.19(c), abatement certification is required for this violation (using CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement or other written records.
