Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of fire and explosion from aluminum dust. Hazards exist due to employees being allowed to smoke in areas where aluminum dust is produced: a) Sanding area - Employees were not prohibited from smoking in hazardous areas. Among other methods, one feasible and acceptable abatement method to correct this hazard is to post all areas with signs prohibiting smoking, educate employees concerning the fire and explosion hazards of aluminum dust and rigidly enforce the requirements. NFPA standard no. 65, Standard for the Processing and Finishing of Aluminum, may be used for guidance.
