29 CFR 1910.146(d)(4)(ix): Under the permit-required confined space program required by 29 CFR 1910.146(c)(4), the employer did not ensure that employees used any other equipment properly which was necessary for safe entry into and rescue from permit spaces: a. On or about September 20, 2013, an employee entered liquid AC tank number 3, a permit required confined space, to cut out a section of pipe. The employee did not have on a full body harness and/or retrieval line, nor any other rescue equipment available when he entered the permit required confined space. b. On or about September 20, 2013, an employee entered liquid AC tank number 3, a permit required confined space, to cut out a section of pipe. The floor of the tank still contained approximately 18 inches of hot liquid tar which was capable of entrapping the entrant. The employer failed to provide equipment, such as but not limited to plywood, to create a safe walking and working surface within the tank, thereby exposing the employee to entrapment and thermal burns from the hot liquid tar.
