29 CFR 1910.106(b)(6): In locations where flammable vapors may be present, precautions were not taken to prevent ignition by eliminating or controlling sources of ignition. Sources of ignition may include open flames, lightning, smoking, cutting and welding, hot surfaces, frictional heat, sparks (static, electrical, and mechanical), spontaneous ignition, chemical and physical-chemical reactions, and radiant heat: a. On or about 9/4/2013, Tank battery, a gasoline powered transfer pump that was not approved for use with flammable or combustible liquids and had a warning label that the muffler area may exceed 150 degrees F, was used to pump crude oil from a storage tank to a plastic portable tank thereby exposing employees to fire and explosion hazards.
