29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toeboards: Note: Toeboards are only required when persons can pass, there is moving equipment or there is equipment with which falling materials could create a hazard. a. On or about August 28, 2013, at the above addressed worksite, an employee was exposed to a hazard of falling 11'-6" to a lower level while using a platform that lacked guardrails to access and/or accessing the dump body of trucks. b. On or about August 28, 2013, at the above addressed worksite, an employee was exposed to a hazard of falling 4'-4" to a lower level while working in standing at the edge of a bay door that lacked guardrails.
