OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employer did not ensure that employees remained a safe distance from tensioned straps during load-handling activities: (a) Gas 008: On or about July 3, 2013 and at times prior, two workers were standing beside the load strap under tension between a track excavator and an attachment point in a bore pipe when the attachment point failed. The shackle connecting the strap and to the attachment point recoiled toward the excavator and fatally struck a worker.
