29 CFR 1910.215(b)(9): The distance between the abrasive wheel periphery(s) and the adjustable tongue or the end of the safety guard peripheral member at the top exceeded one fourth inch: The employer does not keep the tongue guards adjusted to one-fourth inch or less from the wheel periphery. a. This violation was observed on or about June 5, 2013, in the Drill Press Area where employees were exposed to a struck-by hazard when operating the Dayton (110205296) bench grinder that had a 1 inch gap between the right tongue guard and the wheel periphery. b. This violation was observed on or about June 5, 2013, in the Drill Press Area where employees were exposed to a struck-by hazard when operating the Dayton (42910C) bench grinder that had a 1 inch gap between the right tongue guard and the wheel periphery. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that tongue guards are kept adjusted to no more than one-fourth inch gap.
