29 CFR 1910.146(c)(1): The employer did not evaluate the workplace to determine if any spaces were permit-required confined spaces: a) Yard and production floor; On or about May 1, 2013 and at times prior thereto the employer exposed employees to confined space hazards in that the employer allowed employees to enter a confined space on the cement mixer without first evaluating the space to determine if it is a permit required confined space. The employer has multiple silos, aggregate bins, and other confined spaces which have not been evaluated as to permit required or not.
