29 CFR 1917.14: Cargo, pallets, or other materials stored in tiers were stored or stacked in an unstable manner (a) On or about April 18, 2013, employees were replacing the fiberglass reinforced plastic (FRP) lift-off barge covers on the Trinity Barge AEP #3133. The covers were stacked on the side of a steep bank next to the Ohio River. The lack of proper stacking on a level surface per the manufacturer's directions created unstable tiered stacking, which allowed an employee to be struck by a cover when it was moved by high winds and resulted in this employee being fatally injured.
