Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards from precast concrete structures hoisted with the boom truck mounted winch that had a defective and damaged wire rope: a. On or about April 19, 2013, on the boom truck, the wire rope used on the winch was corroded and had not been replaced. b. On or about April 19, 2013, on the boom truck, the wire rope used on the winch was improperly terminated at the aft end of the boom in that the wire rope clips were not properly spaced, the wire rope clip saddles were oriented over the dead end of the wire rope, and the loop of the wire rope did not have a thimble installed to protect the wire. c. On or about April 19, 2013, on the boom truck, the wire rope used on the winch was not adequately lubricated to protect it from corrosion. d. On or about April 19, 2013, on the boom truck, the metal loop welded to aft end of the boom as a termination point for the winch wire rope was deformed and had not been repaired.
