Text For Citation: 01 Item/Group: 002 Hazard:

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by ingoing nip points and rotating parts: a) Harvest Floor - Machine guarding was not provided to protect employees from hazards created by ingoing nip points or other rotating parts from auger systems located adjacent to the aisleway, on or about April 3, 2013. CLEMENS FOOD GROUP, WHO WAS PREVIOUSLY NAMED HATFIELD QUALITY MEATS , WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD, WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 311272868, CITATION NUMBER 1, ITEM NUMBER 1, AND WAS AFFIRMED AS A FINAL ORDER ON NOVERMBER 28, 2008, WITH RESPECT TO A WORKPLACE LOCATED AT 4591 COLEBROOK AVE., EMMAUS, PA, 18049. Abatement Note: One feasible and acceptable method of abatement for guarding the trench auger from the aisleway side where pedestrians or other worker are located would be to install up a guardrail far enough away from the augers that would prevent employees from being able to contact any of the ingoing nip points of the auger blades. If guardrails need to be right next to the augers trenches due to aisle space limitations, then a barrier type guard may be more suitable. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states that employees and their representatives were informed of this abatement.
