Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) Upper level of mix house, dept 077, between #1 and #2 cross-overs on track #1, northeast side of building where employees from the traffic dept. 347, moved railroad cars with locomotive in an unsafe manner, in that no warning system in effect, Plant Procedures #24, item 3, traffic dept. 347, Safety Rules, page 2, section "A", item 11 and JSA #22, was not used to alert employees in that area prior to car movement, thereby exposing them to crushing injuries between moving cars and parked locomotive (Mix Mobile) on the same track, on or about January 1, 1987.
