29 CFR 1904.39(a): The employer did not orally report the death of an employee or the in-patient hospitalization of three or more employees because of a work-related incident a) Libbey Glass, Inc. - Toledo, Ohio: On or about August 1, 2012, the employer failed to report an employee fatality. On July 31, 2012, an employee sustained an injury at the worksite located at 1201 Buckeye St. in Toledo, Ohio, that injury resulted in the death of the employee on August 1, 2012. The employer did not report the employee fatality within 8 hours after the death. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
