29 CFR 1926.652(a)(1)(ii): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section except when: Excavations are less than 5 feet (1.52 m) in depth and examination of the ground by a competent person provides no indication of a potential cave-in. a. At the excavation site located at 812 Georgres Creek Rd. in Gallipolis, Ohio, employees were working at manhole 56-57 on a sewer line in a trench that was 12 feet deep without any protection on one end of a trench sheild that was installed against the end of the excavation, thereby exposing employees to the hazards of a cave-in.
