Labor and Employment Article, Section 5-104(a): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a)Date of Violation:01/02/13 Location:Intersection of South Street and Trammels Alley at Libertytown Fire Station Equipment:Multiquip, Whiteman Series, Power Buggy, Model WBH16, Serial # 260522. Condition:An employee operating a power buggy hauled rocks that were unstable. Among other methods, one feasible and acceptable abatement method to correct this hazard is to follow the manufacturer's instructions on page 8 of the operator's manual, which state: Do not dump materials that are large and chunky. These types of materials may shift causing the power buggy to tip and throw the operator off the machine. The power buggy is intended for dumping free-flowing and loose materials such as dry soil, slag and wet concrete.
